The Supreme Court is poised to end race-conscious admissions. What does this mean for higher education and the goals of achieving a diverse student population? The New-ish First Amendment on Campus 

Speech. Expression. Religion. Association. Privacy. The First Amendment ground rules of the 20th Century are in flux with a textualist, originalist Supreme Court that some have described as “imperial.” The rise of social media and an emphasis on public expression put modern colleges in the role of “referee” in the marketplace of ideas.  Many ideas will also have dedicated advocacy efforts associated with them; and there is no reason to believe the marketplace of ideas will be free from conflict.  Conflict is particularly important to manage in light of increased weaponization. How will modern colleges manage the new dynamics of free expression and advocacy, particularly in the classroom?  How does academic freedom play into all of this? What about the coordinated challenges to DEI efforts and bias response teams?  What important lessons about free speech and advocacy do we need to teach this generation of learners? A major takeaway will be how to focus on places and spaces.  Join Professor Lake as he discusses the frontiers of free expression in the digital age on campus. Has the diminution of privacy and explosion of “publishers” led to a 21st Century obsession with freedom from speech?

Federal Compliance Update – Navigating the New Regulatory Landscape

DSPS Secretary Dan Hereth will share updates on the occupational licensing innovations at the department. He will cover technology innovations and process improvements that are reducing decision times for license applications. He will also provide a view on additional enhancements currently in development, and he will take questions from participants. The department has incorporated stakeholder feedback into its work and looks forward to additional insights for regulated professions.

Cyber Resiliency in the Education Sector and the Importance of Prioritizing Cybersecurity Investments

Educational institutions are a prime target for ransomware attacks. In 2023, there has been a significant uptick in ransomware attacks, especially within the education sector. During these attacks, threat actors are gaining access to schools’ networks and disrupting their websites, local servers, Wi-Fi, internal phone systems and more. In many cases, the threat actors are also exfiltrating sensitive data, such as information on payroll, personal finances, student admissions data, and even social security numbers. These events render schools' IT systems inaccessible and impact a school’s ability to perform to its full capacity, sometimes even causing schools to cancel classes or extend their school year. Ultimately, as schools’ research capabilities develop and their databases become more elaborate, the amount of proprietary information, personal health records, and personally identifiable information continues to increase, ultimately making them an even more attractive victim for threat actors.  During this session, two Cyber Placement Specialists from Marsh will be doing a deep dive into the trends within the cyber threat landscape and the cyber insurance market, with a specific focus on the education sector. Please attend this session if you are interested in learning about how educational institutions can develop and execute strategies to help identify, transfer, and mitigate cyber and technology risks.

There are significant differences in process, paperwork, and determining who has authority for making determinations about each of these; and it is important to understand the differences among them.
